These Terms of Service ("Terms") govern your access to and use of Tovi ("Tovi", "we", "our", or "us"), a private digital gallery for children's artwork, operated from California. By accessing or using Tovi, you agree to these Terms. If you don't agree, please don't use the service.
Tovi is a private digital gallery that lets parents and guardians photograph, organize, and share their children's artwork with family members. The service includes a mobile app and web-based gallery pages that invited family members can view in a browser.
Tovi is currently in private beta. During this period, access is by invitation only, the service is provided free of charge, and features may change without notice.
You must be at least 18 years old to create a Tovi account. By using Tovi, you represent that you are 18 or older and have the legal capacity to agree to these Terms. Tovi is intended for use by parents and guardians on behalf of their children — children do not create accounts or use the service directly.
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@jointovi.com if you suspect unauthorized access.
You may not share your account with others or create accounts on behalf of people who have not agreed to these Terms.
You own the content you upload to Tovi — photos of artwork, names, and any other material you add ("Your Content"). By uploading content, you grant Tovi a limited license to store, display, and transmit it solely for the purpose of operating the service for you and the people you invite.
We will never use your content for advertising, sell it, or share it with third parties beyond what is necessary to operate the service.
You are responsible for ensuring you have the right to upload any content you add to Tovi. You agree not to upload content that:
We reserve the right to remove content that violates these Terms and to terminate accounts of users who repeatedly or egregiously violate them.
Tovi generates private gallery links that you can share with family members. You control who you share these links with. Anyone with a link can view the gallery it points to — please share links only with people you trust.
Gallery pages are not indexed by search engines, but we cannot guarantee they will remain private if a link is shared beyond your intended recipients. You may disable or revoke gallery links at any time from within the app.
Tovi is in private beta. This means the service is still being developed and may have bugs, limited availability, or incomplete features. We may change, suspend, or discontinue any part of the service at any time during the beta period, with or without notice.
We will make reasonable efforts to preserve your data, but we recommend keeping your own copies of any artwork photos that matter to you.
Tovi is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability and fitness for a particular purpose.
To the fullest extent permitted by California law, Tovi's total liability to you for any claim arising from these Terms or the service — whether in contract, tort, or otherwise — is limited to the amount you paid us in the twelve months preceding the claim, or $100, whichever is greater.
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, even if we have been advised of the possibility of such damages.
You may stop using Tovi and delete your account at any time. We may suspend or terminate your access if you violate these Terms or for any other reason with reasonable notice, except in cases of serious violations where immediate termination is warranted.
Upon termination, your content will be deleted in accordance with our Privacy Policy.
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these Terms will be resolved in the state or federal courts located in California, and you consent to personal jurisdiction in those courts.
We may update these Terms from time to time. When we do, we will update the date at the top of this page. For material changes, we will notify you by email. Continued use of Tovi after a change takes effect constitutes your acceptance of the revised Terms.
